About the Information Regulator

The Information Regulator is an independent body established in terms of Section 39 of the Protection of Personal Information Act (POPIA) 4 of 2013.
It is empowered to monitor and enforce compliance by public and private bodies with the provisions of both:

  • The Promotion of Access to Information Act (PAIA) 2 of 2000, and

  • The Protection of Personal Information Act (POPIA) 4 of 2013.

Who Needs to Register

All private bodies are required to register with the Information Regulator.
This includes the following entities:

  • Non-Profit Organisations registered with the Department of Social Development

  • Sole Proprietors

  • Partnerships

  • Trusts

  • Private Companies, Non-Profit Companies, and Close Corporations

  • Any other private organisation, whether registered with a regulatory body or not

Failure to submit annual returns may affect your Compliance Status with CIPC, as CIPC assists in monitoring these submissions.

Compliance Requirements

All trading entities must:

  • Have a PAIA Manual on record

  • Comply with the submission of yearly POPIA Reports

  • Appoint an Information Officer as per Section 55(2) of the POPIA Act

Duties of the Information Officer

The appointed Information Officer is responsible for:

  • Encouraging compliance within the entity

  • Developing policies and procedures for the lawful processing of personal information

  • Handling access-to-information requests under POPIA

  • Cooperating with the Information Regulator during investigations (as per Chapter 6 of POPIA)

  • Ensuring full compliance with POPIA provisions

Submission Timeline

Yearly POPIA and PAIA reports must be submitted between April and June.
The first submission period was April – June 2025.
